Wrongful Dismissal in Ontario- Know Your Rights
In Ontario, employees can be terminated without cause- but only if they are provided with proper notice or compensation in lieu of notice. If your employer has let you go without giving you adequate notice or fair compensation, you may have been wrongfully dismissed.
Common Signs of Wrongful Dismissal
You were terminated without cause and given only the bare minimum Employment Standard Act (“ESA”) entitlements
Your employer alleged “just cause” without proper investigation or warning
You were pressured to resign or sign a severance agreement on the spot
Your termination package did not include compensation for bonus, commissions, or benefits
How Much Notice Are You Entitled To?
Many employees are entitled to more than the ESA minimums– especially if they have been with the employer for several years, are older, or held specialized or senior roles. Under common law, notice periods can range from a few months to over 24 months, depending on the situation.
Why Legal Advice Matters
Employers often offer far less than what you are legally entitled to. Once you sign a severance agreement, you may give up your right to claim anything further. It is crucial to speak with an employment lawyer before signing anything.
