What Is Severance Pay?

Severance pay is compensation that may be owed to an employee when their employment is terminated without cause, particularly if they have been with the company for a longer period of time. It is separate from termination pay and is meant to compensate for loss of employment and provide support while you transition.

In Ontario, your entitlement to severance pay can come from two sources:

  • Minimum standards under the Employment Standards Act (ESA)

  • Your full common law entitlements, which are usually much more generous

Who Qualifies for Severance Pay in Ontario?

Under the Employment Standards Act, you may be entitled to severance pay if:

  • You’ve worked for the employer for 5 years or more, and

  • The employer has a payroll of at least $2.5 million, or

  • The employer is terminating 50 or more employees within a 6-month period

But even if you don’t qualify under the ESA, you may still be entitled to common law severance, which is based on:

  • Your age

  • Length of service

  • Position and responsibilities

  • Availability of similar employment

Do NOT Accept Less Than You Deserve

Employers often offer severance packages that are far below what the law allows. Signing a severance agreement without legal advice can mean giving up your right to thousands of dollars in compensation.
