What Is Workplace Harassment?
Workplace harassment is defined under Ontario’s Occupational Health and Safety Act (OHSA) as engaging in a course of vexatious comment or conduct that is known or ought reasonably to be known to be unwelcome. It can include:
Unwanted jokes, insults, or name-calling
Bullying, intimidation, or yelling
Spreading malicious rumours or gossip
Sexual harassment or unwanted physical contact
Targeting an employee based on race, gender, age, religion, disability, or other protected grounds
Harassment can come from anyone—your supervisor, coworkers, clients, or even third-party contractors. And it doesn’t have to happen in person: emails, messages, and social media can all be grounds for action.
Your Employer’s Legal Duties
Employers in Ontario are legally obligated to:
Maintain a harassment-free workplace
Implement a workplace harassment policy
Investigate complaints of harassment promptly and fairly
Protect employees who come forward from reprisal
Failing to meet these obligations may entitle you to compensation—and in some cases, additional damages for the manner in which your complaint was handled (or ignored).
