Harassment at Work: Know Your Rights

Workplace harassment can take many forms- verbal, physical, psychological, or sexual- and it can make even the most capable and dedicated employees feel unsafe, humiliated, or powerless. At K. Miller Law, we help individuals stand up to harassment and enforce their rights with strength, dignity, and clarity.

What Is Workplace Harassment?

Workplace harassment is defined under Ontario’s Occupational Health and Safety Act (OHSA) as engaging in a course of vexatious comment or conduct that is known or ought reasonably to be known to be unwelcome. It can include:

  • Unwanted jokes, insults, or name-calling

  • Bullying, intimidation, or yelling

  • Spreading malicious rumours or gossip

  • Sexual harassment or unwanted physical contact

  • Targeting an employee based on race, gender, age, religion, disability, or other protected grounds

Harassment can come from anyone—your supervisor, coworkers, clients, or even third-party contractors. And it doesn’t have to happen in person: emails, messages, and social media can all be grounds for action.

Your Employer’s Legal Duties

Employers in Ontario are legally obligated to:

  • Maintain a harassment-free workplace

  • Implement a workplace harassment policy

  • Investigate complaints of harassment promptly and fairly

  • Protect employees who come forward from reprisal

Failing to meet these obligations may entitle you to compensation—and in some cases, additional damages for the manner in which your complaint was handled (or ignored).

How We Can Help

At K. Miller Law, we take harassment seriously. We assist clients with:

  •  Seeking damages for emotional distress, lost income, and bad faith conduct
  • Negotiating fair severance packages if the work environment becomes intolerable

We understand how difficult it can be to speak up- especially when the problem comes from someone in a position of power. We are here to protect your interests and advocate fiercely on your behalf.
