Your employer cannot terminate you for taking stress leave. Under Ontario’s Human Rights Code, employers have a duty to accommodate your mental health condition up to the point of undue hardship. If you are dismissed while on leave, you may have grounds for a wrongful dismissal or human rights complaint.
